Welcome to Atlanna Fi. These Terms of Service (“Terms”) govern your access to and use of atlannafi.com (the “Site”) and the Atlanna Fi waitlist and referral program (together, the “Service”), which is operated by Atlanna Fi (“Atlanna Fi,” “we,” “us,” or “our”).
By accessing the Site, joining the waitlist, or participating in the referral program, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old and legally able to enter into a binding contract to use the Service. By using the Service, you represent that you meet these requirements and that the information you provide is accurate and current.
2. The Waitlist
Joining the waitlist reserves your position in line for early access to Atlanna Fi when it launches. It is not a contract for any financial product, account, deposit, loan, security, or investment and creates no obligation on our part to provide any product or service. We may change product features, launch timing, pricing, and availability at any time, and we may decide not to launch at all. Your position on the waitlist confers no ownership interest or guaranteed benefit.
3. Referral Program
Each waitlist member receives a personal referral link. When a new user signs up through your link and confirms their email, that signup is credited to you, which may move you up tiers and earn you the rewards described on the Site. By participating, you agree:
- Not to spam, mass-email, or otherwise distribute your referral link in a manner that violates law, third-party terms of service, or anti-spam regulations (including CAN-SPAM, CASL, and GDPR);
- Not to create fake, duplicate, automated, or fraudulent signups, or to use bots, scripts, paid traffic that misrepresents the source, or incentivized clicks to manipulate referral counts;
- Not to misrepresent yourself as an employee, agent, or spokesperson of Atlanna Fi.
We may, in our sole discretion, void referrals we determine to be fraudulent or in violation of these Terms, adjust your tier accordingly, suspend your participation, or remove you from the waitlist. Reward fulfillment is contingent on continued compliance with these Terms and on the underlying product launching.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose;
- Attempt to gain unauthorized access to any portion of the Service, related systems, or networks;
- Interfere with the operation of the Service, including by attempting to overload, flood, or disrupt our servers;
- Reverse engineer, decompile, scrape, or otherwise extract source code or data from the Service except as expressly permitted by law;
- Impersonate any person or entity or misrepresent your affiliation;
- Submit content that infringes intellectual property rights, is defamatory, obscene, or otherwise objectionable.
5. Intellectual Property
The Site and Service — including all software, text, graphics, logos, designs, and other content (other than user submissions) — are owned by Atlanna Fi or its licensors and are protected by U.S. and international intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Service for your personal, non-commercial use. All rights not expressly granted are reserved.
6. No Professional Advice
Information on the Site is provided for general informational purposes only. Nothing on the Site is intended to constitute, and should not be relied upon as, financial, investment, tax, legal, or other professional advice, or as an offer or solicitation to buy or sell any security or financial product. You should consult a qualified professional before making any financial decision.
7. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR AVAILABILITY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
8. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL ATLANNA FI OR ITS AFFILIATES, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100).
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the limitations above may not apply to you.
9. Indemnification
You agree to defend, indemnify, and hold harmless Atlanna Fi and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of a third party.
10. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including if we believe you have violated these Terms. You may stop using the Service at any time by emailing us to remove your waitlist record. Sections that by their nature should survive termination (including Sections 5 through 11) will survive.
11. Governing Law and Disputes
These Terms are governed by the laws of the State of Georgia, United States, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Georgia, and you consent to the personal jurisdiction of those courts. You and Atlanna Fi each waive any right to a jury trial.
12. Changes to These Terms
We may modify these Terms at any time. If we make material changes, we will update the “Effective” date and, where appropriate, give you notice by email or by a notice on the Site. Continued use of the Service after changes take effect constitutes acceptance.
